Legal advice urges City to withdraw appeal for Upland Excavating landfill

The City of Campbell River has backed out of an appeal for an Upland Excavating landfill on Gold River Rd.

The appeal was in relation to an operational certificate for a new landfill, which allows for the construction and operation of an engineered landfill for releasing certain waste.

“This includes demolition, construction and land clearing waste,” City Manager Deborah Sargent says.

The Ministry of Environment has provided documents to address some of the City’s technical concerns and questions about landfill operations.

The City’s decision to withdraw the appeal is based on legal advice and the review of these documents.

“Council is looking to explore various options to manage the operation and expansion of the landfill through the municipal zoning bylaw, which sets out where commercial and industrial activities are permitted in the community,” Sargent adds.

The City first filed the appeal to the Environmental Appeal Board last August.
