Marine Harvest Canada appeals court decision

Marine Harvest Canada has filed an appeal regarding the Federal Court’s recent decision regarding aquaculture regulations and the transfer of salmon to ocean-based farms.
According to Director of Public Affairs Clare Beckman, the appeal was filed on factual errors Justice Rennie made in his findings.
Backman says the fish disease known as heart and skeletal muscle inflammation has never been detected in Canada, and certain viruses are known to be relatively common that existed in B.C. before salmon farming.

 


In the appeal, Marine Harvest says that Justice Rennie also erred in law by not placing the onus on the applicant to show that the aquaculture license conditions were unreasonable.

 
The Minister of Fisheries and Oceans has also filed an appeal.
